WYLON® Wolong Xinyun Cloud Platform Private Beta & Public Beta Service Terms

Scope of application: These Service Terms apply to all services, functions, product capabilities, etc., of the WYLON® Wolong Xinyun Cloud Platform (hereinafter the “Cloud Platform” or the “Platform”) during the private beta (Private Preview) and public beta (Public Preview) phases.
In order to regulate the User's conduct in using the testing services of this Cloud Platform, to clarify the rights, obligations, and risk responsibilities of both the Cloud Platform and the User, and to protect the lawful rights and interests of both parties, the User has fully read, understood, and voluntarily accepted the entire contents of these Service Terms before applying for, registering for, or using the private beta or public beta services. The User's activation of a testing service is deemed agreement to the entire contents of these Service Terms, whereupon these Terms take effect.
1. Definitions of Terms
- WYLON® Wolong Xinyun Cloud Platform: refers to the official cloud service platform that is independently operated by its owner, Qianshi Xinyun (Shanghai) Technology Co., Ltd. (hereinafter “Qianshi Xinyun” or “we”), providing cloud computing, networking, storage, computing power, applications, and supporting technical services.
- Private beta service (Private Preview): refers to the not-yet-officially-launched testing service that the Platform opens, via a targeted invitation mechanism, only to specific users, partners, and enterprise customers. It is a confidential test version and is subject to confidentiality constraints.
- Public beta service (Public Preview): refers to the unofficial testing service that the Platform opens publicly to all registered users, with no mandatory confidentiality constraints, but which has not yet reached the standard of an officially commercial service.
- Officially commercial service: refers to the standardized cloud service that the Platform has finished testing, has officially released to the public, has a standard SLA service commitment for, and that can be commercially used in a compliant manner. It is not subject to these testing Service Terms.
- User: refers to the natural persons, enterprise legal persons, and other lawful organizations that voluntarily apply for, activate, and use the Platform's private beta and public beta services.
2. General Principles
- The private beta and public beta services are both the Platform's non-commercial, experimental testing services, which differ from the officially commercial service and do not possess complete stability, security, availability, or after-sales support capabilities.
- These Service Terms are general binding terms. The Platform may, in accordance with the characteristics of individual testing products, supplement special testing rules, and the supplementary rules have the same legal effect as these Service Terms.
- The User undertakes to use the testing services only within a lawful and compliant scope, and may not use the testing services to engage in any conduct that violates national laws and regulations, the Platform rules, public order and good morals, or that infringes the interests of third parties.
3. Special Terms for the Private Beta Service
3.1 Access Eligibility and Usage Restrictions
- The private beta service adopts a targeted invitation system and is open only to users designated by the Platform. The User has no right to apply for and activate it on its own; the Platform holds the absolute right to select, refuse, and revoke private beta eligibility, and need not give advance notice or explain its reasons.
- Private beta eligibility belongs exclusively to the applying entity. Transfer, sale, lending, leasing, or sharing is prohibited, and the right of use may not be opened to any third party such as external personnel, enterprises, or institutions; it is limited to the User's internal testing and evaluation use.
- The private beta service is strictly prohibited from being connected to production environments, core business systems, or external commercial services, and may only be used for internal function testing, performance verification, experience evaluation, and problem feedback.
- The User may not store, process, or transmit highly sensitive data such as citizens' sensitive personal information, financial data, classified data, or enterprise trade secrets in the private beta service; otherwise, all risks and responsibilities shall be borne by the User itself.
3.2 Confidentiality Obligations
- The User confirms that all private-beta-related content constitutes the Platform's commercial confidential information, including but not limited to not-yet-launched functions, product interfaces, technical parameters, performance data, program vulnerabilities, testing documents, internal meeting contents, optimization plans, etc.
- The User undertakes to strictly perform confidentiality obligations and is prohibited from, in any form, taking screenshots, screen recordings, or photographs of, copying, disseminating, lecturing on, publicly discussing, spreading within communities, or exposing to the media, etc., the private beta content.
- Without the Platform's written authorization, the User may not disclose private beta confidential information to any third party, and may not use it for non-testing purposes such as personal research and development, commercial replication, or competitive-product analysis.
- This confidentiality obligation shall not lapse upon the end of the private beta, the termination of eligibility, or the deregistration of the account; that is, the confidentiality obligation is permanently and continuously valid. If the User violates the confidentiality agreement, the Platform has the right to immediately terminate the testing eligibility, ban the account, and pursue, in accordance with the law, the User's full legal liability and the economic losses caused to us.
3.3 Service Commitments and Risk Disclaimers
- The private beta service is provided on an as-is basis, with no SLA service-level commitments whatsoever, and the Platform does not guarantee the availability, stability, continuity, or security of the service.
- The Platform has the right, in accordance with needs such as product iteration, technical optimization, and risk control, to suspend, take offline, roll back, modify, or clear private beta data at any time, without advance notice to the User, and bears no liability for any compensation or indemnification whatsoever.
- The private beta data does not come with an official backup guarantee; all testing data risks shall be borne by the User itself, and the User shall back up important testing data in advance and/or periodically on its own.
- For risks arising from the use of the private beta service, such as business interruption, data loss, data leakage, system faults, third-party infringement, and economic losses, all shall be borne by the customer itself, and the Platform is exempt from accountability and compensation.
4. Special Terms for the Public Beta Service
4.1 Access and Usage Rules
- The public beta service is a publicly open service of the Platform; all registered users of the Platform may voluntarily apply for activation. The Platform may, depending on resource conditions, set public beta quotas, activation periods, and usage allotments.
- Public beta eligibility is limited to use by the User itself / its own enterprise / its own organization entity; reselling, sharing, reselling on, leasing, and bulk-registering to grab testing eligibility and resources are prohibited.
- The public beta service is an experimental version, and there are or may be risks such as missing functions, vulnerabilities, leakage, and instability. It is not recommended for use in core production business, important data storage, external commercial services, etc.
- The User may not use the public beta service to carry out abusive conduct such as network attacks, crawler harvesting, malicious volume-inflation, resource occupation, or the dissemination of unlawful and non-compliant information.
4.2 Fees and Service Cycle
- During the public beta, the service is by default free or offered at a preferential price. The Platform reserves the right to adjust fees, commence charging, change packages, restrict resources, etc., at any time.
- The public beta service cycle is determined independently by the Platform. The Platform has the right to end the public beta, convert the service to officially commercial, or take the service offline and shut it down at any time, requiring only an announcement publicized via the Platform, without separately notifying the User.
- After the public beta ends, the Platform has the right to clear the User's testing data and reclaim testing resources. The User shall complete data migration and backup in advance on its own; the Platform bears no responsibility for data retention or recovery, nor any responsibility for data loss caused by the User's failure to perform data migration and backup.
4.3 Service Assurance and Disclaimers
- The public beta service has no official SLA assurance, no dedicated 24/7 operations and maintenance, no emergency-fault response, and no fault-compensation mechanism, providing only basic community or ticket-based Q&A support.
- The Platform makes no express or implied commitment regarding the stability, security, compatibility, or completeness of the public beta service.
- For all consequences arising from the User's use of the public beta service, such as business losses, data anomalies, security risks, and third-party complaints of infringement, all shall be borne by the User itself, and the Platform bears no legal or economic liability.
5. General Intellectual Property and Feedback Rules
- All intellectual property of all testing services of the Platform, including but not limited to copyright, patent rights, trademark rights, trade secrets, technical algorithms, interface design, and functional systems, belongs exclusively to the Platform.
- For all contents submitted by the User during the private beta and public beta, such as BUG feedback, optimization suggestions, experience reports, and improvement plans, the Platform enjoys a free, perpetual, sub-licensable, and commercially usable right of use, without paying any fee to the User.
- The User may not decompile, reverse-engineer and crack, disassemble the source code of, replicate and imitate, secondarily develop, or distribute and disseminate, etc., the Platform's testing services.
6. Service Termination and Handling of Violations
- Where the User engages in any of the following violations, the Platform has the right to immediately take measures including but not limited to terminating testing eligibility, banning the account, and clearing data, etc., and reserves the right to pursue accountability and seek recovery:
- A private beta user violates the confidentiality agreement, disclosing the Platform's confidential testing information, etc.;
- Using the testing service for production operations, commercial profit-making, or external services;
- Storing or processing sensitive classified data in violation of the rules, giving rise to security risks;
- Abusing testing resources, maliciously attacking the Platform, or interfering with the Platform's normal operation;
- Transferring or selling testing eligibility, or lending it to a third party for use or sharing it; or
- Other conduct that violates laws and regulations and the Platform rules.
- After the testing service is terminated, the clauses of these Service Terms concerning confidentiality obligations, intellectual property, disclaimers, accountability, etc., continue to be valid.
7. Other General Terms
- Amendment of terms: The Platform has the right to revise these Service Terms at any time in accordance with business iteration and policy updates, and the revised terms take effect upon being publicized via the Platform; the User's continued use of the testing service is deemed acknowledgment of the latest contents of the Service Terms.
- Independent validity: Where any clause of these Service Terms is found to be invalid, this does not affect the legal validity of the remaining clauses.
- Dispute resolution: Any disputes arising between the parties in connection with the testing service and these Service Terms shall be resolved through negotiation as a priority; if negotiation fails, they shall be submitted for litigation to the people's court at the location of the Platform's operating entity.
- Entire agreement: These Service Terms constitute the entire agreement between the parties concerning the private beta and public beta testing services, and supersede all prior oral and written communications and agreements between the parties.
[The User has read and is fully aware that: the private beta and public beta services carry inherent risks, voluntarily bears all usage risks and responsibilities, and voluntarily abides by all the provisions of these Service Terms.]
